1.1. These are the General Conditions of Use (hereinafter, the Conditions) that govern the legal relationship derived from the contracting processes performed by the users of the web page located at the URL shop.sanfermin.com (hereinafter, Sanfermin.com Booking).
1.2. Sanfermin.com Booking is owned by and the responsibility of Destino Navarra, S.L., with registered office at c/ Mayor, 58. 31001 Pamplona-Iruña (Spain) and Tax ID code B-71.117.030, a company incorporated by public instrument on 12-14-2012 (US) before the Notary Public of Pamplona Rafael Unceta Morales under the ordered number in his records 1962, and registered in the Commercial Register of Pamplona, Tome 1647, Folio 77, sheet NA-32677.
1.3. It shall be understood that access to, the purchase of products or services from, or the mere use of Sanfermin.com Booking by the User implies full, unreserved acceptance of each and every Condition that Destino Navarra, S.L. publishes at any moment in time at which the user accesses Sanfermin.com Booking.
2.1. Through Sanfermin.com Booking, Destino Navarra, S.L. provides an online platform through which it offers different types of tourism services or tourism packages (rental of balconies for the Bullrun, breakfasts, dinners, guided tours and other services), related to the fiesta of San Fermin, and the Users of the web page can make reservations.
2.2. Although it makes every effort to ensure that the service provided is as precise as possible, Destino Navarra, S.L. cannot verify or guarantee that all the information is accurate, complete or correct. Destino Navarra, S.L. accepts no liability for errors (such as manifest or typographical errors), interruptions (due to temporary and/or partial server outages, repair, updating or maintenance of the website or other reasons), inaccurate, misleading or false information, or lack of information.
2.3. The services provided are solely intended for personal, non-commercial use. Consequently, the resale, deep-linking, use, copying, monitoring (e.g. spider, scrape), showing, downloading and reproduction of the contents, information, software, products and services made available on the website for any commercial or competitive activity is strictly prohibited.
3. CREDIT CARD
3.1. Destino Navarra, S.L. needs the User’s credit card details in order to guarantee his/her reservation and may verify the card details (e.g. preauthorizing the card). Secure Socket Layer (SSL) protocol technology is used to protect and encrypt your credit card information during this process.
4.1. On making a reservation, the User accepts the relevant conditions of cancellation and other additional terms and conditions regarding the tourism service or package that may affect his/her reservation. The general conditions of cancellation for each package or service are available on the website throughout the reservation process and in the confirmation email. Some prices or special offers do not permit modification or cancellation.
4.1. Users who wish to revise, modify or cancel a reservation should consult the confirmation email and following the instructions given. Cancellation surcharges may be applied in accordance with the conditions of cancellation of the tourism package or service.
5.1. To the extent to which it is permitted by law, Destino Navarra, S.L. only accepts liability for direct damage that the User may suffer, pay or contract as a result of defects attributable to its obligations regarding its services to the total amount of the total cost of the User’s reservation (be it due to one event or several events).
5.2. Notwithstanding and to the extent to which it is permitted by law, Destino Navarra, S.L. cannot be held liable for: (i) special, indirect or consequential loss or damage, loss of production, profit, income or contracts, loss of or damage to customers or reputation, or loss of demand; (ii) errors related to the description of the information (including information on prices, availability and classification) regarding the packages or services on the website; (iii) loss, damage or costs (direct, indirect, consequential or punitive) that may be suffered, contracted or paid arising from or relative to the use, unavailability or delay of the website; or (iv) any type of harm (personal), death, damage to property or other type of damage, loss or expense (direct or indirect, consequential or punitive) that may be suffered, contracted or paid, be it as a result of acts (legal), errors, infringements, negligence (evident), deliberate poor professional conduct by third parties, omissions, breach of obligations by third parties, misrepresentation, strict liability tort or (completely or partially) third party liability regarding the tourism package or service, including any form of cancellation (partial), overbooking, strike, force majeure or other act beyond Destino Navarra, S.L.’s control.
6. INTELLECTUAL PROPERTY
6.1. Destino Navarra, S.L. is the holder or licensee of the intellectual and industrial property exploitation rights of the website and the contents made available through it. Under no circumstances shall it be understood that permitting Users access to the website implies any kind of waiver, transfer, license or transfer, total or partial, of these rights by Destino Navarra, S.L.
7. WRITTEN COMMUNICATION
7.1. By using Sanfermin.com Booking, the User accepts that most of his/her communication with Destino Navarra, S.L. shall take the form of electronic communication. Destino Navarra, S.L. will contact you by email. For contractual purposes, you consent to the use of this electronic means of communication and recognize that all contracts, notifications, information and other communications that Destino Navarra, S.L. may send you by electronic means comply with the legal requirements of written communication. This does not affect your legally recognized rights.

9. APPLICABLE LEGISLATION
9.1. The present General Condition are subject to Spanish legislation. More specifically, the present Conditions are subject to the provisions of Act 7/1998, of April 13, on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, approving the Consumers and Users Act, Royal Decree 1906/1999, of December 17 1999, regulating telephone and electronic contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Act 7/1996, of January 15, on Retail Trade, and Act 34/2002, of July 11, on Information Society Services and Electronic Commerce.
9.2. Any discrepancy regarding the object of the present General Conditions shall be subjected to the Jurisdiction of the Courts and Tribunals of Pamplona.
9.3. The present General Conditions concluded between Destino Navarra, S.L. and the User describe the rights and obligations of the parties in their entirety.
